Terms Of Service

1. GENERAL TERMS.

I only communicate in English language. If you are unable to clearly communicate in English, translator or not, your inquiry won't be accepted.
By ordering a commission you agree to these Terms of Service and Privacy Policy.
By ordering a commission you declare that you are of legal age.
I reserve right to not accept your commission order without any reason or explanation.
I have right to alter my Terms of Service at any time.
- New rules will not apply retroactively and won't influence orders started on older terms.
By commissioning me in any kind of way, you are agreeing to the terms of service below.
I will communicate via Discord or here on my website but will NOT discuss commission work via an journal, public forum service or comments. Such as payments, prices, email info or PayPal links, ext.
Except for “artistic license” commissions, the Client should already have a general idea of what they want before initiating contact with the Artist. If the Client is unsure about certain details, the Artist can provide suggestions, but the core of the commission should already have been decided.

2. WHAT THE ARTIST WILL AND WON'T DRAW.

I'm full comfortable drawing/illustration:
- Human, Arthro, Alien, Monsters and Furry characters.
- Canon x Canon, OC x OC, My Oc x Your Oc, OC x Canon, and commissioned Fan Art.
- Using Photo References.
- Emotional pictures [fear, joy, frustration, and etc.)
- Logos
- Gore.
  - Pastel gore, candy gore, blood, guts, veins, and exposed mussels.
- Most fetishes:
  - Pet play, bondage, blood, some gore, size difference, monsters, and special genitalia.
- Closed Species related art.
  - Reference Sheets for Traits.
  - Shops and Items.
- Any character in a Closed species.
  - I've drawn before:
    - Daintys, Sharkies, War Paint Demons, Kitty-Kois, Archanes, Bloompuff, Candy Fauns, Ampha & more!

I will NOT draw/illustrate:
- Anything that shows hate speech or hate crimes, anything political, religious, or satire.
- Any hateful artwork; racism, sexism, homophobia, or other harmful/offensive political or social propaganda.
- Adult content including:
  - Animals, Non consent, rape, pregnant characters, and underage characters.
  - Food/feeding, diapers, vore, fecal matter, vomit or hyper/inflation.
- Anything depicting fecal matter or vomit.
- Bara/super muscular characters.
- Overly detailed architecture\perspective.
- Full body Mech/Robots animatronics.
- Full rendered realism.
- Any gore with bugs, or insects with aggressive violent gore involving death.

3. COMMISSION TIME / WAIT TIME

Work In Progress will only be given if the commissioner personally ask for it and if the price exceed 50$/5000 points.
- I will not do another work on the commission until I hear back from the commissioner.
- WIPs might be given as well if I the artist, wonder something about the commission.
The time for your commission to be completed can be up to 3 months depending on many factors such as;
- Health, order of commission, complexity, Work, school or family issues.
- If any of the things stated above occurs you will be notified asap

4. CUSTOMER SATISFACTION & COMMUACATION

I will do everything I can to make my customers happy but If I don't feel comfortable with the idea\concept, I have a right to reject the commission order.
I am willing to learning something new; if the subject matter is new to me, I will work with you from concept to completion to complete your commission to the best of my abilities.
Client has the right to request a total of three (3) major alterations to the sketch or line art before incurring additional charges for the extra time.
- The three major alterations can only be requested during the sketch and line art phases without incurring additional charges.
- Additional fees for revisions for major alterations will be charged at the rate of $15 per hour unless otherwise agreed upon between the client and the artist.
However after a commission is finished, only small changes are allowed to be made.
- Such as small coloring/marking mistakes.
Any great changes will come with an extra charge.
- Such as an outfit change, outfit addition or subtraction, background change or anything that makes me have to redraw it completely.

If your reference was unclear to start with, then you are not allowed to do minor changes without a fee.
Make sure to be clear in your order what you aim for.
Required for References:
- One or more detailed image(s) of your character/subject matter.
- Provide mutable images your character/subject matter are preferred (front, back, both sides, etc.)
- Optional: A short, written description of key features of your request that may not be obvious in the reference images. Up to five (5) sentences maximum.
- Please refrain from sending any details or material about the character/subject matter that do not directly apply to the picture requested.

At any point during a commission, if I do NOT receive a reply from the Client within two weeks (14 days), the commission may be canceled. If payment has already been received in whole or part, full or partial refunds are left to the Artist’s discretion depending on the amount of work already completed.
I don't necessarily work on commissions on a first-come, first-served basis. Smaller commissions may be bumped in front of larger commissions for convenience, and several larger projects may be worked on concurrently.
A commission will be canceled at any time if the Client is excessively or continuously rude, demanding, childish, or inappropriate. The Client will not be refunded and will be blacklisted.
By providing me with the references for your commission you declare that you have full copyrights or the owner’s permission for usage of the character design depicted on those references.
If order involves multiple clients, all communication with the artist should be handled by a single representative elected privately by said group, regardless to the amount of people that paid for the commission. I will not be involved in any quarrels among the group members nor responsible for the resulting situations. I won't be updating each person involved in project, all updates will be passed to selected representative only.
I may refuse service to any Client for any reason.

5. PAYMENT

Base prices are subject to change without notice; quotes requested or discussed prior to price updates are not affected.
Quotes or Price Estimates can be requested at any time throughout the month.
- Quotes expire after 1 month. Receiving a quote is not equivalent to your commission being accepted.
All commissions must all be paid in full upfront.
I only accept payment through PAYPAL.
I only accept USD (United States Dollars)
Payment is expected within 24 hours, unless otherwise discussed.
I do NOT accept echecks or mailed cash.
Never send payment without my approval, because if you do, I will consider it a tip or donation and may not refund you.
All sales are final once payment has been received.
There are no refunds.
I can do payment plans with commissions over $200:
- Example: Pay $25 a week so I'll do the sketch the 1st week you pay then wait until the next payment. For both commissions and customs.
Adopts, Designs that you bought or commissioned.
- You can trade\gift any customs you get from me (unless stated otherwise).
- They can be resold for the same price unless there is additional art drawn or commissioned of them.
The commission process is updated on Queue.
Tips and Donations are appreciated, but not necessary.

6. ADULT CONTDENT & NSFW WORK.

Reference pictures and/or photos should be provided by the Client that are NSFW (Not Safe For Work) links should be marked as such. Other references may be suggested by the Artist if the Artist finds certain details unclear.
Only purchases an NSFW image if you +18, I will not sell these types of images to minors.
Fetish work im commutable with:
- Pet play, bondage, sex toys, light blood, size difference, and special genitalia.

7. ADOPTS & DESIGNS

Small changes to the design are acceptable as long as the design is still recognizable to the original and you do not edit the original artwork.
You can of course change the name, gender, species of the adopt as long as it adheres to the above staement and does not infringe on any other person’s original species rules.
All sales of designs are final.
Violation of agreement means I reclaim the design and may resell or reuse.

8. AUCTIONS

Do NOT retract your bids. If you retract your bid, especially without notice, you will be suspended/banned from the next or all future auctions.
Auctions always end on the date listed, or 1 day after the last bid.
If outbid, you are no longer obligated to pay me anything once the auction has ended, even if the person who outbid you broke the rules and retracted their bid.
In the event that the winner breaks the rules and retracts their bid or cannot pay, I will ask the runner up if they’d like to purchase at their last bid price, but they may decline.
Payment is due within 24 hours of me notifying you for winning, unless otherwise discussed beforehand.
If you fail to pay within this time and without notice, I will offer the prize to the next person.
Auction may be cancelled, postponed, or extended in the event of no bids in the first 24 hours or breaking the rules with retracted bids occur.

9. COPYRIGHT / USAGE POLICY / DISPLAY

All Rights Reserved.
I have no claim of ownership on characters depicted.
The Client may use the artwork for non-commercial, non-promotional purposes.
The Client may resize or crop the artwork to create icons, wallpapers, or other graphics.
The Client cannot directly alter the artwork itself (eg, the Client cannot change the hair color or other features of depicted characters, etc).
I can display commissioned work on any personal website or gallery, create prints or other products, use commissioned work in promotional materials, etc. If the commissioned work is a time-sensitive gift, the Artist may delay public showcase at the request of the Client.
Do not redistribute, claim, copy, edit, or use it in any way.
My artwork is copyright to me. You are not allowed to use my artwork by any means without my permission!
Only the commissioner of a piece of artwork may reupload the work.
The commissioner may also, if desired, use the work as part of a ref or crop it for an icon.
You are not allowed to edit my art in any way! That also means no coloring my uncolored work!

Clients are required to save there commissioned work.
I am not responsible for deleted or missing commissions from my galleries.
Artist’s clean up their galleries every so often, so please if you care about your commissioned art, you will SAVE them to your computer or privately on imgur or photobucket, etc.
You are not allowed to complain, get a refund, or a redo of your commissioned art.

I, the artist, hold every right to the produced drawing, not the commissioner.

Therefore I´m allowed to use the copyrighted artwork to;

Promote myself with in any place or site.
To display it anywhere to my liking.
Post it wherever I want.

The commissioner are allowed to;

Use the copyrighted artwork for personal use only unless agreed otherwise.
Print the art, and claim the right of their character(s) but not the drawing itself.
Use the art to promote themselves with proper credit given to the artist.

If you break the copyright infringement in any way, every right you had to the drawing will be retracted.

The following is considered Copyright infringement:

Reproducing/using the copyrighted artwork commercially. (Meaning making money of it in any way)
Taking Credit for the creation of the artwork.
Removing any watermarks/signatures.
altering the artwork without my, the artist´s, consent.

A Purchase of Commercial rights to the artwork will always be 300% of original price.
With commercial rights you are allowed to make any sort of merch with the artwork.
Use it in books, covers, as Props, change it to your liking and promote your own brand with.
Credit is still required for usage of the artwork, even if altered or edited.

PRIVATE COMMISSIONS ALWAYS COME WITH A 50% FEE
